Terms of Service

These Terms govern your access to and use of Blustar (the “Service”), operated by Blustar (“we”, “us”). By installing the Blustar app from the Shopify App Store or by accessing the Service, you agree to these Terms. If you do not agree, do not install the app.
1. The Service
Blustar is an AI assistant that helps Shopify merchants edit their store through natural-language chat: generating sections, rewriting copy, applying SEO fixes, generating images and video, translating, scheduling tasks, and (optionally) integrating conversion-rate analytics. The Service is available only to merchants with an active Shopify store.
2. Eligibility & account
- You must be at least 18 years old and have authority to bind your business.
- You must have an active Shopify store and complete the OAuth handshake.
- You are responsible for the activity that happens under your shop’s OAuth token.
3. Plans, credits, billing
Blustar offers tiered plans (Starter, Pro, Agency) billed monthly through Shopify’s Billing API. Each plan includes a monthly credit allowance. Credits are consumed by chat turns, image generation, video generation, and other AI-backed actions. Unused monthly credits do not roll over. Top-up credits, if purchased, do not expire as long as your subscription is active.
Pricing is shown at install and inside the app. We may change pricing with at least 30 days’ notice; changes apply from the next billing cycle. Refunds follow Shopify’s standard refund policy for app subscriptions.
4. Acceptable use
You agree NOT to use Blustar to:
- Violate any law, regulation, or third-party right (including IP, privacy, consumer protection).
- Generate content that is deceptive, defamatory, hateful, harassing, sexually explicit involving minors, or designed to mislead customers about the nature of products.
- Send spam, scrape, or otherwise abuse the Shopify Admin API beyond rate limits.
- Reverse-engineer, decompile, or attempt to extract our prompts, models, or proprietary logic.
- Resell or sublicense the Service without our written permission. Agency-plan users may operate Blustar for client shops they manage.
- Run security tests, load tests, or vulnerability scans against the Service without prior written consent.
We may suspend or terminate any account that abuses these rules.
5. AI-generated content disclaimer
Outputs from Blustar (generated copy, Liquid sections, images, videos, SEO metadata) are produced by large language models and image/video generators. You are responsible for reviewing every output before publishing it to your live store. We provide a preview-before-apply flow for exactly this reason. Blustar does not warrant that outputs are accurate, free of bias, free of third-party IP claims, or fit for any particular purpose.
Images and videos generated by third-party models (e.g. Replicate, fal.ai) are subject to the terms of those providers. You retain ownership of generated content to the extent permitted by those terms, but you accept the risk that AI outputs may incidentally resemble existing works.
6. Your content & license to us
You retain ownership of all data you bring into Blustar (products, theme files, brand kit, prompts). You grant us a limited, non-exclusive licence to process that data solely to operate the Service for you. We do not use your content to train AI models. See the Privacy Policy for full details.
7. Modifications to your store
Blustar can write to your theme files, templates, theme settings, product descriptions, prices, and create new pages/sections — but only when you instruct it to. Every destructive bulk action (bulk price adjustment, bulk description rewrite, theme publishing) requires explicit confirmation. We maintain a change log so you can review what was edited and roll back where supported.
That said: maintain your own backups. Shopify Theme “Duplicate” before large edits is the simplest safety net. We are not liable for content you authorised us to overwrite.
8. Service availability
We aim for high availability but do not guarantee a specific uptime SLA on Starter or Pro plans. Agency plans include a 99.5% monthly SLA with service credits for downtime — see the Agency addendum delivered at subscription.
Third-party model outages (Anthropic, Google, Replicate, etc.) may temporarily degrade specific features. We will fail over to alternative providers where possible.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS CAPPED AT THE AMOUNT YOU PAID TO BLUSTAR IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR LOST-PROFIT DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY.
Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g. gross negligence, wilful misconduct, statutory consumer rights).
11. Indemnity
You agree to indemnify and hold us harmless from third-party claims arising out of (a) your misuse of the Service, (b) content you instructed Blustar to publish that infringes third-party rights, or (c) your breach of these Terms.
12. Termination
- You can uninstall Blustar from your Shopify admin at any time.
- We can terminate or suspend your access if you breach these Terms or if your Shopify subscription lapses.
- On termination, sections 5, 9, 10, 11, and 14 survive.
13. Changes to these Terms
We may update these Terms. Material changes will be notified by email at least 14 days before they take effect. Continued use after the effective date is acceptance.
14. Governing law
These Terms are governed by the laws of Spain. Any dispute will be resolved before the competent courts of Barcelona, Spain, unless mandatory consumer-protection rules require otherwise.
